At Capturly, we are dedicated to respect and preserve your personal information. This Privacy Policy forms part of our Terms and Conditions of Use and represents our privacy practices. It demonstrates the details of how we collect information from your browser and device when you use any of our services.
This Privacy Policy applies to the websites and subdomains (“Sites”) owned and operated by Capturly, Inc. In this Privacy Policy Capturly, Inc. (Capturly,” “we,” or “us”) states what information will be collected when you access the Sites or the service of Capturly, Inc. how this information will be processed, how and when can you access your information. We ensure transparency by letting you know how you can control the data collection process, correct and/or delete information. Capturly, Inc. will not use or share the information collected from you with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information collected from other sources (this includes offline).
Capitalized terms that are not defined here can be found in our Terms. The information collected through our service will have limited usage defined in this Privacy Policy and our Terms of Service and can be only applied to our customers.
A. How does Capturly collect information?
You give us information in two ways:
- The information you give us by signing up to Capturly intentionally. By creating your Capturly account or signing up for contents/offers, we ask you for your email address and website URL. We use this to provide you with the service that you have signed up for. This may contain personally identifiable information as well. If you decide to deactivate your account and/or unsubscribe from receiving contents or offers, contact us here.
During a visit session on our site, some of your personal information will be stored. These include the name of your internet service provider (“ISP”), the duration and the date of the visit, basic information about the device you visited from (the type of the device, operating system, web browser type, screen size and resolution, language and the country you are located in). A portion of your IP address will be also stored, however, Capturly, Inc. makes sure to anonymize the format by leaving out the last octet. This way the full IP address will never be stored on our servers and we will not have access to it. Standard internet log information and the behavioral patterns upon visits are being processed using cookies in order to improve user experience and to aid basic functions.
- After your permission is given we may also collect further information, while navigating through and interacting with the content on the Site and the content on our users' site pages, and information on your computer or another device (like cookies). Your full IP address is never stored or shared with any third-parties. Capturly changes the last octet to zeroes for IPv4 addresses or changes the last 80 bits to zeroes for IPv6 addresses before it got stored. Capturly is also prepared with a code snippet in order to deny Capturly tracking on pages where personal information may be shown. We honor the Do Not Track option of the different browsers, if this option is enabled in your browser then it won’t be tracked.
- Our only purpose of collecting information is to improve your experience when using the sites and web services of our users. Capturly was not designed to show how a specific identifiable person is using a website or a webapp. We respect and apply the “Privacy by design” principle of the General Data Protection Regulation (GDPR) and honor the California Consumer Privacy Act (CCPA).

Through the Capturly tracking code embedded by our users on their own website(s), the pieces of information collected are:

- Log data (we do log the login sessions in order to ensure fast reaction times in case of security breaches

Please note that you can be only identified via your email address. Also, note that we are only able to address your request if we have Personal Data about you through having direct and/or indirect contact (by using our site and/or service) with us.
B. How does Capturly work?
We provide our users with an individual tracking code (which is used to collect information and transmit
it to our servers). Visiting a website which uses Capturly, our tracking code will automatically
collect information about your activity and store it on our servers, for our users. We collect
information with cookies too, which are placed on your computer/device by the website.
We do not intend to collect information personally identifying the visitors of our users’ websites. Be aware
that clients are capable of obtaining such personal information with the use of our Service.
As our user you agree to that you will implement a privacy policy on your website that is in compliance
with ours and you shall provide your visitors all relevant information in regard to the collection of
information via the use of Capturly and also warn visitors about the possibility of opting-out from Capturly
collecting visitor information with a link (https://capturly.com/site/optout).
Capturly will not be liable under any circumstances for any user's failure to make these disclosures on its
website, retrieve any necessary consents or the user’s use of visitor information not permitted by applicable
law or this Privacy Policy.
C. What kind of cookies are used by Capturly?
In case of visiting capturly.com, we collect standard internet log information and visit details with the use of cookies. The sole purpose of this act is to verify the number of active visitors of the site and it does not contain any information that would make it possible to personally identify anyone.

D. How do we protect Capturly data?
- Contact to the information stored on our servers is restricted to Capturly employees and to users. Our employees, users and third parties (third parties who are not defined in this Privacy Policy can be found in our Terms) are bound by confidentiality.
- Our servers are secured by firewalls and IP restrictions.
- Each client can only approach information belonging to the relevant site(s) and to the visitor(s) browsing its pages.
- We use HTTPS for Capturly providing secure transfer of data in order to prevent wiretapping and man-in-the-middle attacks.
- Capturly, Inc. will not transfer the information collected, stored, and processed in the European Union (including personal information) to a country and jurisdiction that does not apply the same laws and data protection principles as your jurisdiction.
- We do our best to ensure the protection of your data and privacy, however, please note that we can not warrant the security of information you transmit to Capturly, Inc. There is no method of transmission in existence over the Internet or electronic storage that is secure to an absolute level.
- We use a secure third party credit card processing company to manage the billing services, which may not store, share or use personally identifiable information aside from the agreement.
- In case of a data security breach, we at Capturly, Inc. will make sure to notify our customers together with the applicable law. To prevent such events from happening, we conduct security testing. In order to keep our security levels up to date, we train our employees constantly.
- Capturly, Inc. operates a separate resolution mechanism with the highest priority in order to manage privacy related issues.

Capturly, Inc. does not take any responsibility towards information, content, services or practices linked to or from the Capturly Service or sites. This Privacy Policy does not apply to third parties defined in our Terms and any form of interaction on third party websites or services (this includes clicking on links or advertisements on our website), are subject to the third party’s Privacy Policy.
In the event of noticing we will delete any personal information, we have collected from children under the age of 13 without any hesitation. Capturly, Inc. takes the protection of privacy of young children very seriously. E. Availability of information and its exposure
The information collected is only available on the user's Capturly account. However, it may also be accessible by Capturly in certain limited circumstances.
- We will not expose any information to any third party. It might be mandatory to share your personal information (or part of it) with Cloudflare which store the information on their servers, only for storage.
- We will also expose your personal information where we are bound to do so (by law or via a court order).
The collected information is only available on the given user’s account and for Capturly employees in given situations.
Regarding any personal information about our customers that Capturly keeps on file as a Data Collector, we provide the opportunity to review, correct, update or delete. You have a right to be informed of Personal Data processed by Capturly and a right to restrict the processing. You have the right to request a structured and machine-readable format of the data you provided to us. If a users profile is deleted we also delete any information is stored regarding the given profile. Due to security reasons, our users are only able to change their passwords manually in their settings, after they had logged in.

You agree that Capturly, Inc., in its sole discretion, may use your company name, domain names, logo or
other applicable trademarks, at any time, for the purpose of referencing you as a customer on the Capturly
Website or in other promotional marketing materials.
You hereby acknowledge and consent to Capturly making use of any of Your trademarks to identify You as our customer.
G. Opt-out
You can always opt-out from Capturly collecting information about you while visiting a Capturly website.

H. Versions of this Policy
We may periodically update this policy.
The present version of the Privacy Policy can be found at https://capturly.com/privacy. We will alert you
of any changes via email (to the email connected to your account). By continuing to access Capturly, after
the changes become effective, you agree to be bound by the renewed privacy policy.
We notify our users if there’s a new version of this policy available. The users are always bound to
the newest version by default.
